TERMS OF PURCHASE

These Terms of Purchase apply to all digital products, consultations, coaching programs, group coaching programs, challenges, courses, memberships, and other services ("Services") offered by Daily Wellness for You LLC ("Company," "we," "us," or "our").

By checking the box indicating your acceptance of these Terms and completing your purchase, you ("Customer," "Client," or "you") agree to enter into a legally binding agreement with Daily Wellness for You LLC, a Wisconsin Limited Liability Company.

1. SERVICES PROVIDED

Services offered by Daily Wellness for You LLC may include, but are not limited to:

- Personalized health consultations

- Individual coaching programs

- Group coaching programs

- Membership programs

- Challenges

- Self-guided programs

- Online courses

- Downloadable resources

- Videos, workbooks, guides, handouts, recipes, meal plans, PDFs, and other educational materials

- Group coaching and community support, when applicable

Digital Materials and Printed Copies

Unless otherwise expressly stated on the applicable sales page, all workbooks, guides, handouts, recipes, meal plans, PDFs, downloads, and other educational or program materials are provided in digital format only. The Company does not provide printed or hard copies of digital materials. You are responsible for downloading and, if desired, printing materials for your own personal use, including any associated printing or delivery costs. The Company is not responsible for printing, mailing, or otherwise delivering hard copies of digital materials.

The specific features, deliverables, limitations, and refund policies for each Service are outlined on the applicable sales page.

By purchasing, you acknowledge that you have reviewed and accepted the description, scope, limitations, and refund policy of the Service you selected.

2. EDUCATIONAL PURPOSES ONLY

All information, recommendations, educational materials, consultations, coaching sessions, programs, videos, downloadable resources, social media content, newsletters, blog posts, and other materials provided by Daily Wellness for You LLC are intended for educational and informational purposes only.

The Services are not intended to diagnose, treat, cure, or prevent any disease.

Always consult with your physician or qualified healthcare provider before making any changes to your diet, nutritional supplements, exercise routine, medications, or lifestyle practices.

Nothing provided by Daily Wellness for You LLC should be considered a substitute for medical care provided by your physician or qualified healthcare provider.

Never disregard professional medical advice or delay seeking medical care because of information provided through the Services.

3. FUNCTIONAL NUTRITION CONSULTATIONS AND COACHING SERVICES

Services provided by Daily Wellness for You LLC focus on nutrition, lifestyle, education, consultation, coaching, and overall wellness support.

Services may include discussions related to:

- Nutrition

- Lifestyle habits

- Physical activity

- Sleep

- Stress management

- Macronutrients

- Food-as-medicine principles

- Available lab results

- Functional lab recommendations

- Supplement education and personalized supplement strategies

Nothing provided through consultations, coaching sessions, programs, digital products, educational materials, videos, newsletters, social media, or any other Services offered by Daily Wellness for You LLC is intended to diagnose, treat, heal, cure, or prevent any disease, illness, medical condition, mental health condition, or emotional condition.

The Services provided by Daily Wellness for You LLC are educational and supportive in nature and should not be interpreted as medical advice, diagnosis, treatment, or a prescription.

Nothing provided by Daily Wellness for You LLC is intended to replace the medical care, diagnosis, treatment, or advice provided by your physician or qualified healthcare provider.

Although Barbara Diaz de Leon is a Registered Nurse licensed in the State of Wisconsin, she is not acting in the capacity of a licensed healthcare professional when providing these Services. All Services are provided solely in the capacity of a health and wellness coach and functional nutrition educator.

Participation in any Service does not establish a physician-patient, nurse-patient, dietitian-patient, therapist-patient, or other healthcare provider-patient relationship.

Clients are responsible for maintaining an ongoing relationship with their physician and qualified healthcare providers for:

- Medical care

- Medical evaluations

- Physical examinations

- Diagnoses

- Prescription medications

- Mental health care

- Emergency medical services

In the event of a medical emergency, call 911 or contact your physician immediately.

Clients acknowledge that they have read, understand, and agree to be bound by the Company's full Disclaimer, which is incorporated into these Terms by reference.

4. LABORATORY TESTING AND SUPPLEMENTS

Functional lab testing and nutritional supplements are optional and are not included in the purchase price of consultations or coaching programs unless explicitly stated.

Additional laboratory testing and targeted supplementation may be discussed when appropriate based on your health history, individual needs, goals, and progress.

There is never any obligation to pursue additional testing or purchase supplements.

5. PAYMENT

Payment is due in full at the time of purchase unless alternative payment terms are outlined during the enrollment process, as part of a coaching program or membership purchase, on the applicable sales page, or otherwise communicated by the Company.

Accepted payment methods may include:

- Credit cards

- Debit cards

- PayPal

- Other payment methods offered through the Company's checkout system

By completing your purchase or enrolling in a Service, you authorize the Company to charge your selected payment method according to the agreed-upon pricing and payment terms.

For Services purchased through a payment plan, installment plan, membership, subscription, or other recurring payment arrangement, you authorize the Company to automatically charge your selected payment method according to the agreed-upon billing schedule.

Failure to make scheduled payments may result in the suspension or termination of access to the applicable Service until the account is brought current.

The Company reserves the right to use third-party payment processors to collect and process payments.

6. REFUND POLICY

Digital Products, Challenges, Courses, and Membership Programs

Due to the digital nature of downloadable guides, challenges, courses, workbooks, memberships, online communities, and other digital resources, all sales are final and non-refundable once access has been granted.

Consultations

Consultation fees are non-refundable.

If a consultation package includes multiple sessions, all sessions must be scheduled and completed within the timeframe specified on the applicable sales page.

Coaching Programs, Group Coaching, and Group Challenges

Payment terms, payment plans, refund policies, and any additional program-specific policies will be outlined during the enrollment process, on the applicable sales page, and/or in the Coaching Agreement provided at the time of enrollment.

Membership Programs

Fees for membership programs are non-refundable unless otherwise stated on the applicable sales page.

Membership cancellations will apply to future billing cycles only and will not result in a refund for the current billing period.

7. SCHEDULING, RESCHEDULING, AND MISSED APPOINTMENTS

Consultations and coaching sessions must be scheduled and completed within the timeframe outlined for the specific Service purchased.

The included 45-minute Follow-Up Consultation provided as part of the Vibrant You Metabolic Blueprint must be scheduled and completed within three (3) months of the initial 90-minute consultation. Unused follow-up sessions that are not completed within this timeframe will be forfeited unless prior arrangements for an extension have been approved by the Company.

For consultations that require the completion of an intake form, all required forms and supporting documents must be submitted at least 48 hours before the scheduled appointment. Failure to submit the required materials within the specified timeframe may result in the consultation being rescheduled.

Requests to reschedule appointments should be made as far in advance as possible.

Missed appointments, late cancellations (defined as less than 24 hours' notice), or no-show appointments may not be eligible for rescheduling or a refund unless otherwise agreed upon in advance by the Company.

Additional scheduling policies may be outlined in the applicable Coaching Agreement.

8. NO GUARANTEE OF RESULTS

Results vary significantly from person to person.

Individual outcomes depend on many factors, including, but not limited to:

- Health history

- Genetics

- Current health status

- Lifestyle factors

- Adherence to recommendations

- Consistency

- Personal motivation

- Environmental factors

Daily Wellness for You LLC makes no guarantees, express or implied, regarding any specific results or outcomes.

Testimonials, case studies, examples, or client experiences shared by the Company represent individual experiences and should not be interpreted as typical or guaranteed results.

9. CLIENT RESPONSIBILITY

You understand and agree that you are solely responsible for your own health decisions, actions, and results.

You assume full responsibility for implementing any educational information, strategies, or recommendations provided by the Company.

10. ASSUMPTION OF RISK

You voluntarily choose to participate in the Services offered by Daily Wellness for You LLC and acknowledge that nutrition, exercise, supplementation, and lifestyle changes carry inherent risks.

You assume full responsibility for any decisions or actions taken based on the educational information provided through the Services.

11. INTELLECTUAL PROPERTY

All content created by Daily Wellness for You LLC, including but not limited to:

- Programs

- Videos

- PDFs

- Workbooks

- Guides

- Trainings

- Downloads

- Handouts

- Written materials

- Graphics

- Website content

is protected by copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use purchased materials for your personal, non-commercial use only.

You may not:

- Copy

- Reproduce

- Share

- Sell

- Distribute

- Modify

- Republish

any materials without prior written permission from Daily Wellness for You LLC.

12. GROUP COACHING CONFIDENTIALITY

For any Services that include group coaching, group calls, online communities, or challenges, all participants agree to maintain the confidentiality of information shared by other participants.

Recording, distributing, screenshotting, or sharing another participant's information without permission is strictly prohibited.

13. PRIVACY

Information collected through coaching applications, intake forms, consultations, purchases, and website interactions will be handled in accordance with the Company's Privacy Policy.

14. ELECTRONIC COMMUNICATIONS

By communicating with Daily Wellness for You LLC through email, video conferencing, online forms, websites, membership platforms, or other electronic methods, you acknowledge that electronic communications may carry inherent privacy, security, and technical risks.

While Daily Wellness for You LLC takes reasonable measures to protect your information, no method of electronic communication can be guaranteed to be completely secure.

If you choose to send laboratory results, health records, food records, or other personal health information by email, you acknowledge that standard email is not considered a secure method of transmitting confidential health information.

By voluntarily providing information through electronic methods, you acknowledge and accept these risks.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Daily Wellness for You LLC shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from participation in any Service.

Your sole remedy, if any, shall be limited to the amount paid for the applicable Service.

16. GOVERNING LAW

These Terms shall be governed by and interpreted according to the laws of the State of Wisconsin.

Any disputes arising from these Terms shall be resolved in Waukesha County, Wisconsin.

17. MODIFICATIONS

Daily Wellness for You LLC reserves the right to update or modify these Terms at any time.

Any changes will be posted on the Company's website.

Continued use of the website or future purchases constitutes acceptance of any revised Terms.
